Man found guilty of sexual assault

Mario Antonio Burciaga, 32, of St. Cloud was found guilty on Thursday in Mower County District Court of felony first-degree criminal sexual conduct-sexual contact with a child under 13, felony first-degree criminal sexual conduct-sexual penetration of a child under 13 by an actor more than 36 months older and felony first-degree criminal sexual conduct–sexual penetration of a child under 16.

Burciaga pleaded not guilty to the charges on July 20.

Austin police and Mower County Human Services received a report in 2014 that a child under age 5 had been sexually assaulted.

While the victim was only able to disclose some information at the time, the victim was later able to tell more of what had happened in summer 2016.

A review of Burciaga’s criminal history shows numerous prior convictions, including assault, terroristic threats, drug possession and harassment-stalking.

Burciaga will be sentenced on Sept. 21. Under Minnesota law, all of the charges carry a maximum penalty of no less than 144 months and no more than 30 years in prison and a $40,000 fine.
