2 sentenced for felony drug sales

Two individuals were sentenced for felony drug sales on Friday in Mower County District Court. Judge Kevin Siefken issued the sentences.

Cully Thomas Shierts, 22, of Clarks Grove was sentenced to 90 months in the Minnesota Correctional Facility in St. Cloud for felony second-degree drugs-sale of 10 grams or more of a narcotic other than heroin. He received credit for 278 days served.

The charge was reduced from felony first-degree drugs-sale of 17 grams or more of methamphetamine as part of a plea agreement reached on Dec. 28.

Court documents state that a confidential reliable informant (CRI) met with narcotics detectives on Dec. 14, 2017, about purchasing methamphetamine from Shierts. The CRI and his vehicle were searched and police gave him buy money and an audio transmitter. The CRI was then monitored as he went to meet Shierts in Austin. Shierts arrived in a 2003 Cadillac, which the CRI entered to purchase the drugs. The CRI then met with police and surrendered two bags of methamphetamine, a total of 55.728 grams.

A review of Shierts’ criminal record shows juvenile adjudications for burglary and convictions for theft, domestic assault and drug possession. He is currently awaiting disposition on charges of felony fleeing a peace officer in a motor vehicle, two charges of felony fifth-degree possession of a controlled substance, receiving stolen property,  possession of metal knuckles and driving after revocation of his license. Those charges are for two separate cases out of Freeborn County.


Michael Scott Fadden

Michael Scott Fadden, 33, of Austin was sentenced to 20 years of probation for felony third-degree drugs-sale of a narcotic.

The charge was reduced from felony second-degree drugs-sale of 10 grams or more of methamphetamine as part of a plea agreement reached on Dec. 28.

Court documents state that a confidential reliable informant (CRI) met with a narcotics officer and drug task force investigator on May 30, 2018, to arrange purchasing methamphetamine from an adult female. The CRI and the woman agreed to meet with her “source” to buy the drugs. The CRI and his vehicle were searched and he was provided with buy money and an audio transmitter.

The CRI picked the woman up in the 200 block of First Avenue Southeast, then drove to Fadden’s residence in the 1500 block of 17th Avenue Southwest. Fadden entered the CRI’s vehicle and they drove to a residence in Albert Lea. The CRI gave Fadden the buy money and Fadden went into the residence, coming out 45 minutes later. They then drove back to Fadden’s residence, where Fadden gave the CRI the drugs.

The CRI surrendered 12.714 grams of methamphetamine to police at a predetermined location and confirmed Fadden had sold him the drugs.

A review of Fadden’s criminal history shows prior convictions for drug possession and theft.

In addition to the probation, Fadden must follow 24 conditions and perform 40 hours of community service. Failure to follow the conditions could result in 27 months in prison.
