Austin man sentenced to over 14 years for sexually abusing child; May have conditional release after 10 years

Ruben Montoya Carbajal, 40, of Austin was sentenced to 172 months in the Minnesota Correctional Facility in St. Cloud for felony first-degree criminal sexual conduct-penetration of a child under 16-significant relationship-multiple acts on Thursday in Mower County District Court. He received credit for 290 days served.

A jury found Carbajal guilty in August. He was also found guilty on three other counts of felony criminal sexual conduct with a child; however, adjudication was made as they were considered lesser offenses.

Judge Christa M. Daily issued the sentence.

Court documents state the victim and her mother met with an Austin police officer on Sept. 1, 2017, and reported that Carbajal had sexually abused the victim.

The victim, who was 15, said it started when she was 12 and that it would happen when her mother was not home.

The victim said the abuse happened multiple times and that Carbajal told her “this is what people do.”

Carbajal denied sexually abusing the victim and said he had no idea why she would accuse him of doing so. He told police that other people told him the victim wanted his attention.

A stipulation of the sentence states that Carbajal could have conditional release after 10 years of confinement. He must also pay $85 in court fees.
