Three plead guilty to methamphetamine sales

Three individuals pleaded guilty on Friday in Mower County District Court to charges of felony drug sales.

All charges stemmed from separate incidents.

Tha Im, 45, of Austin pleaded guilty to felony second-degree sales of 10 grams or more of a narcotic other than heroin as part of a plea agreement. He initially pleaded not guilty on Sept. 13.

A charge of felony first-degree sales of 17 grams or more of methamphetamine within a 90-day period and another charge of felony second-degree sales of 10 grams or more of a narcotic other than heroin will be dismissed at the sentencing as part of the agreement.

According to the court compliant, narcotics detectives met with a confidential reliable informant (CRI) about purchasing methamphetamine from Im on May 9.

The CRI advised that Im would sell ½ an ounce of meth for $500. The CRI and his vehicle were searched and he was given buy money and fitted with an audio recording device. The CRI then picked Im up at his residence in the 200 block of 12th Street Northeast and drove to another part of northeast Austin. Im then exited the CRI’s vehicle and returned 20 minutes later.

The CRI met the detectives at a predetermined location and surrendered 12.93 grams of methamphetamine. He also informed them that Im had to pick up the drugs from his “source” and sold it to him when he returned to the vehicle.

A similar operation was carried out with the same CRI on June 13, in which the CRI purchased 13.36 grams of methamphetamine from Im, which he turned over to the police.

A review of Im’s criminal history shows prior convictions for domestic assault and a firearm violation.

Im will be sentenced on May 17.

Cully Thomas Shierts, 21, of Clarks Grove pleaded guilty to felony second-degree drugs-sale of 10 grams or more of a narcotic other than heroin as part of a plea agreement.

The charge was reduced from felony first-degree drugs-sale of 17 grams or more of methamphetamine as part of the agreement.

According to the court complaint, a CRI met with narcotics detectives on Dec. 14, 2017, about purchasing methamphetamine from Shierts. The CRI and his vehicle were searched and police gave him buy money and an audio transmitter. The CRI was then monitored as he went to meet Shierts in Austin. Shierts arrived in a 2003 Cadillac, which the CRI entered to purchase the drugs. The CRI then met with police and surrendered two bags of methamphetamine, a total of 55.728 grams.

A review of Shierts’ criminal record shows juvenile adjudications for burglary and convictions for theft, domestic assault and drug possession.

Shierts will be sentenced on June 6.

Dakota Ray Janning, 21, of Austin pleaded guilty to felony third-degree drugs-sale of a narcotic as part of a plea agreement. He initially pleaded not guilty on Oct. 29.

A second charge of felony third-degree drugs-sale of a narcotic will be dismissed at the sentencing as part of the agreement.

According to the court complaint, narcotics officers met with a CRI about purchasing methamphetamine from Janning on Aug. 6 and Aug. 8. On both occasions, the CRI and his vehicle were searched and police provided him with buy money and an audio transmitter. Police then monitored him as he met Janning near the dog park and purchased 0.30 grams of methamphetamine from him on Aug. 6. The CRI was monitored again on Aug. 8 as he was picked up by a vehicle in the area of Sixth Street and First Avenue Southwest and dropped off at a residence, where he purchased 5.93 grams of methamphetamine from Janning.

After both purchases, the CRI surrendered the methamphetamine to police.

Janning will be sentenced on June 6.
