The victim told police that Davila had slapped and strangled her before leaving on a green bicycle, the complaint states. She said they had been arguing and drinking that day and that Davila was recently using drugs. She attributed her injuries to an assault that happened two days prior, saying she did not call the police because Davila had threatened to kill her.

The victim reported Davila used both hands to strangle her for about 30 seconds, during which time she could not breathe, the complaint states. While he did so, she said he threatened to kill her.

Davila was located and arrested after a brief struggle at about 1 a.m. on Tuesday.

Davila will appear in court again on Oct. 8.
