Man gets prison for DWI

Billy Gean Garrett Jr., 49, of Faribault was sentenced on Thursday in Mower County District Court to 62 months in the Minnesota Correctional Facility in St. Cloud for felony first-degree DWI-alcohol concentration 0.08 within two hours.

Charges of gross misdemeanor driving after cancellation of his license-inimical to public safety and petty misdemeanor speeding were dismissed as part of a plea agreement reached on June 4. He received credit for 252 days served.

Judge Christa M. Daily issued the sentence.

Garret was arrested on Nov. 2 after an officer observed his vehicle swerving and almost colliding with the median in front of Walmart on 18th Avenue Northwest.

The court complaint states the officer initiated a traffic stop on Fourth Street Northwest and immediately detected a strong odor of alcohol when he made contact with Garrett.

The officer observed an open beer case and an empty brandy bottle in the back seat, the complaint states. Garrett was slurring his speech and failed several field sobriety tests.

While at the Mower County Jail, Garrett provided a breath sample that showed a blood alcohol concentration of 0.12 percent, the complaint states.

Garrett was on probation for another DWI conviction at the time he was arrested.
