Man allegedly punched woman several times

Justin Thomas Rios, 28, of Austin was charged on Wednesday in Mower County District Court with felony domestic assault.

According to court documents, officers responded to a domestic call at 4:36 a.m. on Saturday at a residence in the 400 block of 16th Avenue Southwest. Dispatch advised them Rios had allegedly assaulted a woman at the residence, took her cell phone and her daughter’s cell phone, and left the residence in a 2007 Honda Accord.

A woman at the residence said Rios had grabbed her by the hair and punched her several times, according to court documents. She described him as “very jealous” and that he “tries to control everything” she does. She said he apologized and said he didn’t want to go to jail. She believed he had been using methamphetamine. Officers detected a bump on her head, which she described as “tender.”

The woman called police again on Monday to recant the story, saying Rios did not assault her, according to court documents. She allegedly said she told them the story because she was “upset” and the bump on her head was from her hitting her head at work. When asked if she had reported the injury or if anyone had witnessed the injury, she said “no.” She then allegedly admitted the assault had occurred as she initially reported it.

A review of Rios’s criminal history shows prior convictions for domestic assault and theft.

Rios will appear in court again on June 4.
