According to the court report, officers responded to a call from a man who said Garcia and others were trying to beat up his family at 10:02 p.m. on July 4 in the 1000 block of Fourth Street Southwest. Officers found several people surrounding Garcia, who was on the ground being restrained by an adult male.

Officers spoke to the man restraining Garcia. He said he was outside the residence watching the fireworks with his children near Skinner’s Hill when he heard loud banging noises coming from the direction of his Chrysler Town and Country Van. He said he saw Garcia striking the van with a large metal pipe, breaking the driver side mirror and causing long, deep scratches along the front and rear driver side windows and along the rear passenger side.

Officers found the metal pole on the ground next to the van.

While officers spoke with the man, Garcia and another adult female shouted profanities while many small children and other people were present and able to hear them.

Damage to the van was later estimated at $2,567.15.

Garcia is scheduled to appear in court again on Sept. 28.
