A shirtless man allegedly tried to gain entry into an apartment early Tuesday, yelling to the resident that the resident was evicted and he had to get out.

Austin police said Kenneth Horne, 25, was arrested on suspicion of attempted burglary of the residence on the 500 block of Fifth Avenue Northwest. He is in the Mower County Jail, on a 72-hour hold for a probation violation.

Dispatchers were alerted at 1:43 a.m. of a shirtless man trying to gain entry into the apartment. It is unclear whether the suspect and apartment dweller knew each other.

According to the report, Horne allegedly pounded on the door of the apartment, and when the door was opened, he tried to gain entry. A chain on the door, however, prevented his entry. The report said that the suspect yelled the man was being evicted and had to leave.

When police arrived, they saw a man matching Horne’s description — shirtless — outside the apartment.

When police officers interviewed Horne, they noticed the smell of alcohol, according to the report.

The case has been turned over the county attorney for review.
