An Austin man who dislocated his former housemate’s finger after reportedly kicking his door down was sentenced Friday to five years of probation in Mower County District Court.

Yien Riek Weang, 28, was given probation by Judge Donald Rysavy in lieu of 28 months in prison.

Weang was convicted of third-degree assault after a Jan. 27 incident in which he reportedly kicked open the door of his former housemate’s residence in the 1200 block of 12th St. NW. The victim told police he asked Weang to leave, but Weang attacked him and said, “I’m going to break this house before I leave.”

According to a court complaint, Weang pushed over the television and struck the man in the face several times when he tried to catch the TV from falling over.

The man was taken to Mayo Clinic Health System in Austin with a dislocated finger, swollen left eye, bloody lip and cuts over his right eye.

Weang denied being intoxicated but had a blood alcohol content of .096 percent, according to court documents.

Two first-degree burglary charges and one count of property damage were dismissed when Weang took a plea agreement.
