Man accused of assault changes plea to guilty

An Austin man who allegedly hit a woman on the side of her head changed his plea from not guilty to guilty on one count of felony domestic assault Friday in Mower County Court.

Roger David Miller, 51, pleaded guilty as part of a plea agreement; two other felony domestic assault charges were dropped as part of the agreement.

Court documents said that Miller, of Lyle, allegedly threatened to “kick the crap” out of the woman and her daughter. Miller then allegedly got in the passenger seat of the woman’s car and hit her on the right side of the head with his forearm when she attempted to remove him from the vehicle.

When Lyle-Mapleview police arrived, Miller said the woman had hit him on the right knee with a bottle. Police later identified an injury on Miller’s knee.

Miller’s blood alcohol content when he was arrested was .216.

Court documents state Miller told police he “would not ever hit” the woman.

Miller has been convicted of two past assaults on the woman in March 2006 and July 2007.

Miller’s sentencing is scheduled for Dec. 17.
