Domestic assault charges follow alleged strangulation

A Rose Creek man faces five felony charges in an alleged domestic assault that occurred Sunday night.

Gregorio Pabon-Garcia, 24, has been charged with two counts felony first-degree criminal sexual conduct, one count felony kidnapping, one count felony making terroristic threats and one count felony domestic assault by strangulation.

According to court documents, Pabon-Garcia got into an argument with a woman Sunday night and allegedly strangled her three times in the kitchen of her residence, three times in the living room and one time in the hallway.

The woman told authorities that she was unable to breath and began to black out from lack of oxygen during the strangling.

She also said that Pabon-Garcia would not allow her to leave the house. When she went to the bathroom after the argument, he allegedly entered the bathroom and forced himself on her while strangling her. The woman also told authorities that he threatened to kill her several times during the assault.

The responding deputy photographed injuries on the woman’s back and neck after the incident and reported that she had difficulty breathing and was taken to Austin Medical Center for further medical attention.

Pabon-Garcia provided three different names and two different birth dates to authorities upon arrest. He has been court ordered to surrender any and all false documentation if released on conditional bail.

Pabon-Garcia’s bail was set at $250,000 or $100,000 with conditions, which include daily check-ins with Mower County Court Services, no alcohol consumption and an order to stay at least 500 feet from the victim’s residence, school or work place.

He is scheduled to appear in court again Oct. 21 with Judge Donald E. Rysavy presiding.
