Suspect pleads guilty in fatal Devils Lake boat crash

DEVILS LAKE, N.D. — A man accused in a boat crash on Devils Lake that killed one person and injured three others has pleaded guilty in a deal with prosecutors that likely will put him behind bars for two years.

Thomas Burns, 54, of Grand Forks, pleaded guilty Thursday to felony manslaughter, three counts of felony reckless endangerment and misdemeanor boating under the influence.

Authorities say Burns was drunk on Aug. 9, 2015, when a boat he was operating on Devils Lake struck a tree about 30 yards from shore while traveling at more than 30 mph, at 2:45 a.m. The crash killed April Stenger, 26, of Detroit Lakes, Minnesota, and injured three other passengers — two men from Devils Lake and a woman from Halstad, Minnesota. Burns also was injured.

Ramsey County State’s Attorney Lonnie Olson told KZZY radio that he considered several factors in offering Burns a plea deal, including a 2012 case involving Kentucky National Guard members training at Camp Grafton near Devils Lake. Four were in a vehicle that authorities say crashed while traveling nearly 90 mph down a city street, killing two passengers. The driver was charged and ultimately reached a plea deal.

“He got 10 (years) to serve two, the same sentence we’re offering here,” Olson said.

The Associated Press requested comment Friday from Burns’ attorney, Ward Johnson, on why Burns accepted the plea deal rather than take his case to trial.

A sentencing date was not immediately scheduled. A judge will need to sign off on the plea agreement of two years in prison with eight more years suspended. The maximum punishment Burns could receive is 25 years in prison. He remains free on bond.
