DULUTH — An appeals court has denied the latest attempt by a former Duluth store owner who sold synthetic drugs to keep his property.

Last Place on Earth store owner Jim Carlson is serving a 17-year federal prison sentence for selling synthetic drugs at the store. The federal government seized the property after Carlson was convicted.

In February, a federal judge removed a notice that previously informed potential buyers that ownership of the property was in dispute, since Carlson is appealing his federal sentence.

Carlson appealed the decision in March. WDIO-TV reports that in a one-sentence ruling released Thursday, a panel of three judges from Eighth District Court of Appeals found that Carlson’s appeal was filed too late and dismissed it.
