Conviction sticks for DWI on motor scooter

An Austin man convicted of felony DWI on a motorized bicycle was sentenced to seven years’ probation, 30 days’ electronic home monitoring and fined $500.

Michael James Weis, 44, was arrested at about 2 a.m. July 31 and charged after an Austin Police officer followed him. According to the court complaint, Weis rode a motorized bike with no lights while pulling a trailer before an officer watched Weis run a stop sign and ride on the wrong side of the road. The officer turned on his emergency lights and said Weis looked but turned down several streets before stopping.

Weis reportedly failed several intoxication tests. A test later revealed he had a blood alcohol content of .20, according to the complaint.

Weis’ record shows that he has a previous conviction for felony DWI from 2004 in Houston County, which meant felony charges in this case. Weis pleaded guilty to one charge in Mower County Court, and the other was dismissed.
