Body camera footage released in officer-involved shooting in eastern Freeborn County

The Albert Lea Police Department, Mower County Sheriff’s Office and Steele County Sheriff’s Office have released the body camera footage of their officers on the scene at the officer-involved shooting June 10 in eastern Freeborn County, in which one man was shot and killed.
According to authorities, Nathaniel Dewitt Bailey, 44, led law enforcement on a chase that night after texting a woman that he had shot and killed his mother, Brenda Kay Krause, 66.
Bailey had reportedly fled the scene of the shooting, at 21130 880th Ave. in Oakland Township. When officers tried to pull him over in Mower County, he reportedly led authorities on a chase, before ultimately ending up back at the original house in Freeborn County.
Law enforcement officers with the South Central Drug Investigative Unit SWAT team can be seen in the Albert Lea officer video when Bailey arrived back at the house, running from their SWAT vehicle toward Bailey’s vehicle and then yelling out to Bailey to put his hands up. At one point, one of the officers can be heard yelling to the other officers to take cover.
The video showed multiple shots were fired at Bailey from the officers, though the number of shots fired has not been verified.
Most of the remainder of the almost nine-minute video shows the law enforcement officers as they discuss how to approach Bailey, who at that point was on the ground near a shed after the shots were fired. At that time, they said they could not see his hands and could be heard looking for patrol shields to use for protection as they moved in closer.
As they got closer to him, an officer is heard saying there is a gun in Bailey’s right hand. They also referenced a gunshot wound.
At the end of the video, the officers began providing medical aid and can be heard calling for medics.
The Minnesota Bureau of Criminal Apprehension previously stated Bailey died at the scene.
Video released by the Mower County Sheriff’s Office shows Deputy Katlynne Fischer on a gravel road leading back to the property.
At one point she radios that Bailey had left the vehicle and that she didn’t know where he had gone before spotting him again. A law enforcement officer then radios to be careful and that Bailey had a firearm.
Fischer can then be seen getting out of her squad and yelling “Put the gun down!” before firing several shots. Both her and another officer are heard reporting that shots had been fired.
Toward the end of the video segment, Fischer can be heard telling another officer, “I can see his leg, that’s about it.”
Mower County Sheriff Steve Sandvik, in a release to the Herald, said that law enforcement’s actions at the property were consistent with training.
“Upon arrival the suspect brandished a firearm, and peace officers responded accordingly pursuant to policy,” Sandvik said.
Sandvik said that the release of camera footage is meant as a way to be open with the public.
“The disclosure of this incident, through the body worn camera, which is pursuant to state law, is meant to assuage any concern from the public and provide the needed transparency,” Sandvik said.
He also said, “We continue to hold the original victim and their family in our thoughts.”
Sandvik also said in his release that until the BCA investigation is complete no further information will be released by the Mower County Sheriff’s Office.
The BCA said five law enforcement officers discharged their firearms during the incident, and all were placed on critical incident leave by their respective agencies, per standard protocol. The officers included one each from the Albert Lea Police Department, Freeborn County Sheriff’s Office, Steele County Sheriff’s Office, Mower County Sheriff’s Office and Faribault County Sheriff’s Office.
According to the Ramsey County Medical Examiner’s Office, Krause, who was found deceased at the residence in a subsequent search of the property, died of gunshot wounds, with the manner of death ruled a homicide.
