Trae Le Binnebose, 28, of Austin was charged on Tuesday in Mower County District Court with felony fourth-degree assault of a peace officer-demonstrable bodily harm and misdemeanor driving after suspension of his license.

According to the court complaint, officers were advised at 7:39 p.m. on Monday that Binnebose was reportedly driving a 2012 Nissan Altima without the owner’s permission. The reporting party said Binnebose was driving to Walmart to steal some items. Police were also advised that Binnebose had a suspended license. An officer saw the Altima in the Walmart parking lot and initiated a traffic stop.

The officer made contact with Binnebose, who immediately said he did nothing wrong and that the officer had no reason to speak to him, the complaint states. When asked about his driver’s license being suspended, Binnebose said he was not aware of his driving status.  Binnebose continued to argue with the officer, who informed him he was being detained.

Binnebose got out of the car, but pulled away from the officer and got back into the driver’s seat when the officer tried to handcuff him, the complaint states. The officer attempted to pull Binnebose out of the car, but Binnebose resisted, grabbing his vest and pulling off his microphone. He then pulled the officer toward the door frame, causing him to strike his face on the vehicle, cutting his lip. Another officer arrived on the scene and Binnebose was taken to jail.

Binnebose will appear in court again on Dec. 17.
