Man gets five years in prison for firearm possession; Receives probation for witness tampering

Naney Kwot Omot, 23, of Austin was sentenced on Thursday in Mower County District Court to 60 months in the Minnesota Correctional Facility in St. Cloud for felony violent felon in possession of a firearm. He received credit for 169 days served.

He received a concurrent sentence of 90 days in jail for misdemeanor driving after revocation of his license, but received credit for time served.

Judge Jeffrey Kritzer issued the sentence.

Police received a call on April 3 from Omot’s roommate, who expressed concern about a firearm at their residence in the Key Apartment complex. Officers were given permission to search the apartment and found a 12-gauge shotgun hidden in a tote in a closet.

Due to a prior felony conviction for second-degree burglary, Omot is not eligible to possess a firearm.

Kritzer also issued Omot a concurrent sentence of five years of probation for felony first-degree tampering with a witness-injure in retaliation. He received credit for 142 days served.

A deputy was dispatched on May 9 regarding an assault that took place at the Mower County Jail. The victim said that Naney, along with inmate Kuoviy Kwot Omot, entered his cell that morning and assaulted him, punching and kicking him several times, after the cell doors had been opened to the common area. The victim said his uncle, who was also an inmate, ran into the cell to break up the fight. He stated he believed he was assaulted because he was a witness in Kuoviy Omot’s attempted murder trial, and that the two assailants called him “snitch” and other names while assaulting him. The deputy photographed injuries to the victim’s face, right hand and left rib area.

Surveillance footage showed Kuoviy entering the victim’s cell and assaulting him while Naney stood guard outside.

Omot must follow 18 conditions during the probationary period and pay $85 in fees. Failure to follow the conditions could result in an additional 28 months in prison.
