The murder trial for Desiree Marie Franken, 40, of Rochester was rescheduled to Nov. 13 during a hearing on Friday in Mower County District Court. A pre-trial has been scheduled for Oct. 25.
Franken’s pre-trial was supposed to take place on July 13, with a jury trial scheduled for July 23; however, the unavailability of a key witness caused the court to postpone.
The case will go to a jury trial if no resolution occurs at or before the pre-trial.
Franken was charged with felony third-degree murder and felony third-degree sales of a narcotic in the June 6, 2017, death of an Austin woman who died after overdosing on heroin Franken allegedly sold to her. Franken has pleaded not guilty to both charges.
