According to court documents, police were called at 12:36 a.m. on Monday to the 1000 block of Oakland Avenue West. It was reported that a woman was screaming “get off me” and a man was yelling and kicking a van outside the residence. When police arrived, they saw a van with the passenger door ajar and a broken glass that appeared to have been thrown at the van’s window on the ground. They also noticed blood on the patio outside the apartment where the man and woman were seen entering.
Officers spoke to the woman, who initially said nothing happened, but then indicated that Bautista had called her to come over, according to the court documents. She said he tried calling her several times while she was driving and was upset when she arrived because she did not answer. She alleged that he punched her in the face, causing her to bleed, then pulled her out of the van by her hair and hit her head on the ground. She further alleged the assault continued in the apartment, with Bautista throwing her against the wall and punching her four of five times with both hands while she was on a bed. When she told him to stop because she heard the police cars, he allegedly said he didn’t care.
The court documents state the victim had visible swelling and blood on her right arm/wrist area, a sizable knot on the back of her head, dried blood on her face and a fresh cut on her lip. She was transported to Mayo Clinic Health System in Austin, where a physician diagnosed her with two scalp hematomas and a sprained wrist. The physician allegedly listed the injuries as “substantial bodily harm.”
Officers spoke to Bautista, who had a bloody face and cut lower lip, using the language line, according to the court documents. He allegedly told police the woman got a “hemorrhage” in her nose and that he was bloody because he tried to help clean it. He also allegedly said the cut on his lip was from him trying to bite a pimple to remove it. He denied hitting her, saying they were only playing, and that he was asleep when the police arrived.
Bautista’s next court appearance has yet to be determined.
