Man sentenced to four years for DWI

Zachary Donald Smith, 35, of Austin was sentenced on Monday in Mower County District Court to 48 months in the Minnesota Correctional Facility for felony first-degree DWI-under the influence of a controlled substance. He received credit for 116 days served.
A charge of gross misdemeanor fifth-degree drug possession from the same case was dismissed on June 26.
Judge Christa M. Daily issued the sentence.
Smith was arrested on Nov. 24, 2016, after an officer observed his vehicle going 50 in a 30-mile per hour zone. The officer pulled him over in the 100 block of Ninth Street Northwest. When he told Smith why he pulled him over, he noticed Smith’s pupils were constricted and did not react to the light. Smith passed one field sobriety test, but failed others and had a resting heartbeat of 120 beats per minute. At the Mower County Jail, Smith provided a urine sample, which tested positive for methamphetamine.
A review of Smith’s criminal record shows numerous traffic convictions, including three other DWIs, theft and falsely reporting a crime.
