Heather Lynn Fennell, 34, of Austin was charged on Monday in Mower County District Court with felony fifth-degree drug possession, misdemeanor fourth-degree DWI and petty misdemeanor possession of drug paraphernalia.

According to the court complaint, Mower County deputies observed a 2004 Pontiac Grand Prix turn into a driveway in the 27000 block of 540th Avenue. One of the deputies found that suspicious because there were no lights on at the residence and because the vehicle’s registered owner, Fennell, did not live at that address. When the deputies turned around, they allegedly saw the Pontiac pull out of the driveway and face south, then pull back into the driveway as they approached. The deputies then activated their emergency lights.

When the deputies approached the Pontiac, Fennell was in the driver’s seat and there were two passengers, according to the complaint. The deputies allegedly smelled a strong odor of alcohol coming from inside and saw an open container, which one of the passengers claimed was his. Fennell allegedly had dilated pupils and twitching hands and was instructed to do several field sobriety tests, three of which she allegedly failed. Fennell was then arrested.

While searching the vehicle, a deputy found 5 ½ grams of crack cocaine and a crack pipe between the driver seat and center console, according to the complaint. Both passengers denied it belonged to them.

At the Mower County Jail, Fennell supplied a blood sample, which was sent to the Bureau of Criminal Apprehension laboratory for analysis, according to the complaint.

A review of Fennell’s criminal record shows prior convictions for aiding and abetting theft, obstructing an officer’s duties, criminal damage to property and drug possession.

Fennell will appear in court again on May 21.
