Two charged with having drug paraphernalia in the presence of children

Brandon Lee Moseng, 23, and Shirleen Kathrine Voigt, 22, both of Austin were charged on Tuesday in Mower County District Court with felony storing methamphetamine paraphernalia in the presence of a child.

According to the court complaint, officers came to arrest Moseng on felony warrants at 2:33 p.m. on Sunday at his residence in the 1800 block of Oakland Avenue East. Moseng was wanted for failing to appear at hearings on 2013 felony convictions in Mille Lacs and Stearns Counties. One officer knocked on the door while another used a squad car PA system to advise Moseng to surrender. Voigt answered the door holding a 10-month old infant and allegedly refused to confirm if Moseng was inside. Officers believed she was stalling to prevent Moseng’s arrest.

Officers then saw Moseng in a bathroom and entered the residence to arrest him, according to the complaint. Moseng then allegedly slammed the door and officers had to force it open. Moseng postured like he was going to fight the officers and was subdued with a Taser.

The officers found a digital scale with methamphetamine residue in a garbage receptacle, according to the complaint. Two other children were at the residence with Moseng and Voigt. The three children were left in the care of Voigt’s mother.

A review of Moseng’s criminal record shows prior convictions for financial transaction card fraud, theft, drug possession and burglary. Voigt recently pleaded guilty to possession of methamphetamine in a school zone, for which she is awaiting sentencing.

They will appear in court again on April 16.
