Drunk driver charged with car theft, violating restraining order

Collin Wayne Orth, 29, of St. Cloud was charged on Friday in Mower County District Court with felony taking/driving a motor vehicle without consent.
He was also charged with two counts of felony violating an order for protection. He pleaded guilty to one charge and not guilty to the other.

He also pleaded guilty to felony first-degree DWI-under the influence of alcohol.
According to the court complaint, Orth was arrested on Jan. 11 for driving impaired after being in a single vehicle accident involving a 2006 Dodge Caravan on Highway 105. Orth told one of the responding deputies that a man who kept the Dodge at his property was “going to kill” him.
When contacted, the man said Orth had taken another vehicle from him and crashed it, according to the complaint. He said Orth took the Dodge from his property when he went to look for the other vehicle. He also said the Dodge belonged to someone else.
A deputy met with the Dodge’s owner, who said he wanted to press charges, on Jan. 16, according to the complaint.
On Jan. 23, an agent with Steele County Community Corrections contacted the Mower County Sheriff’s Office to report that Orth had contacted a woman who had an order for protection against him from the Mower County Jail. The woman alleged that Orth called her cell phone on the day of his arrest and again on Jan. 22. She said he commented about “going to prison for two years.”
A review of Orth’s criminal record shows prior convictions for acts constituting adulteration, harassment, fleeing a peace officer, intentional damage to property, theft, burglary, domestic abuse, drug possession and violating an order for protection.
Orth will appear in court again for a hearing and sentencing on April 20.
