Austin man sentenced to 78 months for drug possession

Mower County District Court Judge Jeffrey Kritzer sentenced Samuel Michael Tanner, 35, of Austin on Thursday to 78 months in the Minnesota Correctional Facility in St. Cloud for to felony second-degree possession of 25 grams or more of cocaine or methamphetamine.

Tanner pleaded guilty to the charge, which was downgraded from felony first-degree possession of 50 grams or more of methamphetamine, as part of a plea agreement on Nov. 29.

He received credit for 44 days served.

Police executed a search warrant at 10:55 a.m. on Nov. 14 at Tanner’s residence in the 900 block of Fourth Avenue Southwest. Prior to the search, officers found Tanner and issued him a copy of the warrant. He told officers he had approximately two ounces of methamphetamine in his bedroom and had used methamphetamine the previous day.

Tanner has previous convictions, including felony drug possession.
