A couple that was allegedly involved in a disturbance on Sept. 20 appeared on Thursday in Mower County District Court.
Raul Eduardo Pena Calidonio, 34, of Austin pleaded not guilty to felony second-degree assault with a deadly weapon, felony terroristic threats and felony possession of stolen property. His wife, Jenssy Fabiola Mejia, 31, of Austin pleaded not guilty to felony possession of stolen property.
According to the court complaint, officers responded to a call at 10:02 p.m. on Sept. 20 of a man entering a residence in the 1400 block of 10th Avenue Southwest with a firearm.
A male resident told police that Pena Calidonio brandished and cocked a black firearm while they were arguing over money Pena Calidonio owed him. He told Pena Calidonio to leave when he started making derogatory comments toward a female who lived at the residence.
Mejia intervened and made Pena Calidonio get into a tan 2009 GMC Acadia, which he drove away.
The man told police Pena Calidonio’s vehicle had no front license plate and a fake Minnesota plate on the rear. Both he and the woman living there said they were afraid Pena Calidonio would shoot them.
Police later learned the GMC Acadia was reported stolen in Kansas City, Missouri, in November.
Officers arrived at Pena Calidonio and Mejia’s residence in the 800 block of Fourth Avenue Southwest, where they made contact with the two of them and a juvenile male in a back alley behind the residence. Pena Calidonio and Mejia denied being involved in a disturbance and said they did not have the GMC Acadia. The juvenile said they had not had the vehicle for five weeks.
Pena Calidonio also denied having a firearm.
An officer checked with Immigration and Customs Enforcement and learned the federal agency wanted Mejia held for being in the United States illegally.
An officer found the GMC Acadia parked in the driveway of a residence in the 1100 block of Second Avenue Southwest. Paperwork in the vehicle indicated it belonged to Mejia. A black .177 caliber pellet pistol was hidden nearby.
An officer talked to the juvenile again, who then said they had been at the house and that Pena Calidonio and the male resident started pushing each other during an argument. He denied that a gun was pulled.
Pena Calidonio and Mejia are scheduled for pre-trials on Jan. 19.
