Man charged with assault, terroristic threats

A man who allegedly kicked a woman, threw a chair at her son and threatened him with a knife was charged on Tuesday in Mower County District Court.

Cotsie Octavius Benson, 29, of Austin was charged with two counts of felony second-degree assault with a dangerous weapon, felony terroristic threats and two counts of felony domestic assault.

According to the court report, police received a panicked call from a woman who said she was hiding and told them to come to a residence in the 800 block of Fourth Avenue Southwest at 4:46 a.m. on Saturday. An officer found the woman shortly after at the intersection of Third Avenue Southwest and Seventh Street Southwest talking to dispatch on her cell phone.

She told the officer that Benson, who she said was a “maniac” and “going to kill someone,” had assaulted her. She said she had kicked him and another woman out of the house earlier that night and that he had returned, breaking the door down.

The woman said Benson had assaulted her in the past and that he had kicked her and thrown a chair at her adult son after entering the house. She said he threatened to kill her if she called the police and she did not feel safe returning to her residence.

While she was talking to the officer, her son came out and told them that Benson was damaging property in the residence. He told the officer that Benson had held a knife to him and had thrown a chair at him, damaging the wall.

Officers went to the residence and found the door had been forced open and sustained major damage.

When officers made contact with Benson, he said he and the woman had a verbal argument, but said nothing physical or violent had occurred. He denied threatening her son with a knife and throwing a chair at him, as well as threatening or harming her.

The officers found a hole in the wall where the son said Benson had thrown the chair at him. Officers matched the hole with the leg of a chair that was sitting upside down on the table. Benson was then arrested and taken to Mower County Jail.

Benson has prior convictions for fourth-degree assault and domestic assault from 2007.

Benson is scheduled to appear in court again on Sept. 11.
