An Austin man arrested in a raid Thursday now faces charges stemming from a shooting that occurred at the 800 block of Second Avenue Southwest in the early morning hours of July 8.

Ramiro Alejandro Pena, 20, was charged with a felony for being a violent felon in possession of a firearm in Mower County District Court on Friday.

He was arrested around 7:30 a.m. on Thursday when members of the Austin Police Department, Mower County Sheriff’s deputies, officers of the Southeastern Minnesota Violent Crime Enforcement Team and officers of the Austin/Mower County Special Incident Response Team executed a search warrant on a home on the 800 block of Second Avenue Southwest — one of the homes initially searched after the shooting.

The incident stems to the July 8 incident where police responded to a shooting at 12:58 a.m. and found Jesus Alejandro Ybarra, 23 had been shot just below the left kneecap. According to the court report, police searched Ybarra’s home as well as a second house in the 800 block of Second Avenue later that day.

In the second house they found a loaded Stevens Model 12 gauge shotgun with ammunition similar to shotgun casings found at the scene. They also found several cell phones, eight rifle rounds, a .45 caliber pistol round and two Zolpidem pills.

The court report stated that police executed another search warrant on the second house on Thursday, July 20, where they caught Pena attempting to leave out the back door. He admitted during an interview that on July 8 he was in possession of the loaded shotgun found during the initial search warrant.

Ybarra, an Austin resident, was treated at Mayo Clinic Health Systems in Austin and Mayo Clinic Hospital Rochester, Saint Marys.

Following treatment, Ybarra was taken into custody after police found 296.5 grams of methamphetamine, worth an estimated $20,000, in his residence.

The investigation is still ongoing.

Pena was sentenced to 30 days in jail and 100 hours of community service for gross misdemeanor third-degree riot using unlawful force or violence last year after being involved in a 2015 fight in which he beat several high school-aged teenagers. One teen was stabbed and several were beaten with baseball bats during the fight. Pena is still on probation for that incident.
