Austin man pleads not guilty to drug charges

An Austin man who allegedly sold heroin to two police informants last year pleaded not guilty to drug sale charges in Mower County District Court on Monday.
Charles Marshall Smith, 35, was charged with two counts of felony second-degree drug sale of a narcotic in a school/park/public housing zone on June 28. He also pleaded not guilty to a charge of fifth-degree drug possession.
According to the court report, a police informant contacted a drug dealer to purchase heroin from him on March 30, 2016. Police provided the informant with money and an audio transmitter.
The informant then allegedly met with Smith, an associate of the drug dealer, at the 1100 block of 11th Avenue Southwest near Cullen Park. The informant purchased just over a gram of heroin, then met police at a designated spot and turned over the drugs.
The next day, another informant contacted the same drug dealer and agreed to meet at the Austin Dairy Queen. This informant was also given money and an audio transmitter.
The informant allegedly met up with Smith, who then got into his car and rode with him to First Avenue Northwest. Smith got out and the informant met up with police, telling them the sale was made en route. The informant also purchased just over a gram of heroin, which was given to the police.
Smith is scheduled to go to trial in November.
