MINNEAPOLIS — Two federal judges will hold hearings next month to see whether a man in the Minnesota Sex Offender Program should be released as experts recommend.

The case was put on a fast track after attorney Dan Gustafson argued his client’s rights are violated each day he’s confined.

The state says the man should stay in MSOP because he’s dangerous and needs treatment. Still, MSOP officials petitioned to move him to a less restrictive part of the program.

A special review board is taking up that petition Wednesday, less than a month after it was filed.

Recent Department of Human Services data shows it usually takes nine to 12 months for petitions to be scheduled for hearings.
