DWI suspect faces charges, has prior convictions

A driver who allegedly abandoned his vehicle and fled onto private property to avoid a DWI Wednesday night was charged with four crimes Friday in Mower County Court.
Cody Charles Kominek, 23, of Austin, was charged with DWI and DWI test refusal, felonies, along with misdemeanors for driving after revocation and fleeing a peace officer on foot.
Police responded to a complaint about erratic driving on Eighth Street NE at 8:30 p.m. April 10. A witness described the suspect and said he abandoned his vehicle, climbed over a fence and went onto Hormel’s property.
Officers searched the area and found a person hiding in bushes, according to the police report. The suspect then fled when officers shined lights on him, the report added. A Hormel security officer later detained the suspect and brought him to officers. Officers then handcuffed the suspect after it appeared he would flee again.
According to the court complaint, Kominek said the crashed vehicle was not his; however, keys in his pocket matched the vehicle. The vehicle had struck the curb at 14th Avenue and Eighth Street Northeast, which flattened one tire and bent the connecting arm.
According to court records, Kominek was convicted of DWI in 2007 and 2011.
