Austin man in prison sentenced for additional drug crimes

An Austin man already serving prison time was sentenced Thursday to 10 years probation for two separate drug crimes.

Bryan Douglas Battin, 45, was given probation in lieu of 15 more months in prison. He was convicted of two counts fifth-degree drug possession for incidents in February and April.

According to court documents, police went to Battin’s home on April 6 to arrest him on a pre-trial release violation. When police found Battin in a bedroom, he had a .027 blood alcohol content and admitted he had alcohol and marijuana in his system.

Police found two straws and four “corner baggies” that tested positive for methamphetamine under Battin’s bed, according to a court complaint. The complaint also said the attached child’s room was filled with dirty dishes that “appeared to be weeks old,” dirty diapers, cigarette butts on the carpet, empty beer cans and garbage.

Battin was convicted in March 2010 of fifth-degree drug sales and sentenced to five years probation, according to court documents. He was sentenced to prison in June for violating his probation by possessing drugs in February and April.

Thursday’s sentence is for the actual crimes committed and not for the probation violations involved.
