Austin man charged with sexually assaulting 13-year-old

An Austin man is charged with first-degree criminal sexual conduct for allegedly assaulting a 13-year-old girl.

Daniel Eugene Hall, 34, was arrested after a school counselor reported the accusations to Mower County Human Services (MCHS).

According to the police complaint, a detective with the Austin Police Department received a call Tuesday from a child protection worker at MCHS who received a child maltreatment report involving criminal sexual conduct.

A nurse practitioner said she spoke with the victim, who reported the defendant sexual assaulted her, and she was upset because her mother didn’t believe the assault occurred.

The mother denied to police any possible misconduct.

The victim claimed her mother was keeping her out of school so she wouldn’t report the assault to school counselors. The practitioner said she was contacted by a school counselor Monday, and when the school had spoken with the mother, she claimed she would take the victim to Austin Medical Center (AMC).

When the mother took the victim to AMC, she did not tell them her daughter was a suspected victim of sexual abuse; she reportedly said she wanted to know if her daughter was sexually active. AMC declined to perform a sexual assault kit.

The complaint shows the counselor instructed the mother to report the alleged abuse to MCHS; she did not contact them or file a report.

The detective was concerned the mother was failing to protect the victim and her sister, 9, by attempting to prevent disclosing the report to school officials and failing to report the assault at all.

Both girls were placed on a 72-hour hold. When the mother requested to speak to the victim alone, an official reported the mother attempted to verbally influence the victim.

Officials arrested Hall at his place of employment. When told the allegations were of criminal sexual conduct, “he did not seem surprised,” the complaint stated, and told police he thought the matter had been “nipped in the bud.”

Bond was set a $100,000 or $20,000 with conditions, which include staying at least 1,000 feet from the victim’s residence, school or place of employment.

Hall is scheduled for an arraignment in Mower County Court Feb. 5.
