A taped confession of accused murderer Angelito Doroteo Munoz is under dispute in Mower County Third Judicial District Court.
The questions include whether the confession was given willingly and whether the defendant was advised of all his rights, including the Geneva Convention and the American justice system’s Miranda rights.
The defense wants the confession suppressed and the prosecution is objecting.
An omnibus hearing took 60 minutes today before District Judge Donald R. Rysavy in the Mower County Government Center in Austin.
Mower County Attorney Patrick A. Oman is prosecuting the case.
The defendant’s lead attorney is Joseph A. Buetel of Owatonna. He is being assisted by attorney Evan H. Larson of Austin.
Munoz, 22, was indicted July 8 on one count of murder in the first degree and another count of murder in the second degree.
Munoz is alleged to have stabbed to death Jose Luis Castillo on June 13 at 104 Third Ave. SE.
Witnesses said the defendant had lost a large amount of money to the victim in a poker game earlier that Sunday. Witnesses also testified they saw the defendant withdraw a knife and stab the victim twice in the chest.
Munoz ran from the scene and the victim died later at Austin Medical Center, where attempts to revive him failed.x
The company’s project also will include a new single 161-kilovolt transmission line, about 23 miles in length, to connect the generating station with the Austin Utilities north substation.
A pipeline that will deliver natural gas to the proposed Pleasant Valley Township power plant will be built by Northern Natural Gas. That product is subject to approval by the Federal Energy Regulatory Commission and the Mower County Board of Commissioners.
After the combined Feb. 23 public information meetings and administrative law judge hearings, the proposal’s fate will be determined by an administrative law judge.
A public advisory person has been appointed to assist and advise persons interested in taking part in the Feb. 23 proceedings. That person is Suzanne Steinhauer and she can be reached by telephoning (651) 296-2878 or (800) 657-3794.
Meanwhile, the Mower County Board of Commissioners is waiting for GRE’s reply to the county’s request for a financial consideration.
That is expected to come next week when the county board is tentatively scheduled to meet on the subject.
