Man convicted in 2-year-old niece’s death in 3rd trial

MARSHALL — A man has been convicted of murder in the death of his 2-year-old niece after the Minnesota Supreme Court last year granted him a third trial.

The Independent of Marshall reports Josue Fraga of Worthington was found guilty on five counts of murder by a jury in Lyon County District Court Thursday night. He was sentenced to life in prison without the possibility of parole. Fraga’s niece, Samantha, died in 2008.

After Fraga was found guilty in his first trial, new evidence emerged and a second trial was ordered, resulting in another conviction.

The state Supreme court ordered a third trial last year after determining a juror in the second trial could have been biased.
