Marvin Perez was charged Tuesday with first-degree burglary, fifth-degree assault, fleeing a police officer and damage to property.

Homeowners discovered Perez in their home at the 700 block of Second Avenue Northwest before 3 a.m. Sunday after he snuck in through a bedroom window. One of the homeowners managed to drive Perez away.

Officers investigating the burglary heard the suspect break a tree branch in the backyard and later spotted him lying down in an attempt to hide from police.

After a foot chase, Perez gave himself up when he heard Austin’s police K-9 unit barking.

Yet Perez attempted to resist arrest when he tried to kick and headbutt officers while he was taken into custody. He also refused to get into a squad car.

Perez sustained a cut on his face during his scuffle with officers, according to the court complaint. He was taken to Mayo Clinic Health System in Austin before he went to jail.
