What will happen to the Millers’ sons now?

Although Judge Fred Wellmann upheld the Millers’ parental rights, the boys will not return to their parents yet.

According to attorney Dan Donnelly, who represented Charity Miller in the case, the boys will enter into Child in Need of Protective Services (CHIPS) plans in which the goal is reunification of the family.

“The parents have already signed onto a case plan,” Donnelly said. “That will require them to take parenting classes, seek psychological help if necessary and other services offered by the county.”

Donnelly said there could be another termination of parental rights case in six months if the Millers do not cooperate with the case plan.

“At that point the county could most likely show they’ve attempted reunification but the parents have not cooperated,” Donnelly said. “The onus is really on the Millers here to cooperate with Mower County if they want their children back.”

Until Brian and Charity Miller have completed their case plan, the boys will likely remain in protective custody.
