Sheriff: Illegal immigration process is out of our hands

When it comes to enforcing illegal immigration laws, Sheriff Terese Amazi’s hands are tied.

“We cannot enforce immigration laws,” Amazi said. “We can enforce forgery … and violation of state law, but there is no state law that allows us to enforce immigration status. Period.”

Amazi said because immigration laws are under federal jurisdiction and are not handled by state and local authorities, she and her deputies, along with the Austin Police Department, are unable to investigate potential illegal immigrants. This means local authorities are powerless when it comes to conducting raids on Hormel Foods Corp., Quality Pork Processors, Inc. and other businesses where undocumented workers are frequently discovered, she said.

“When people think you can (do a raid) and you can’t, it’s very frustrating,” Amazi said.

“We’ve sat down with Immigrations and Customs Enforcement (ICE) and they’ve said, ‘We won’t do a raid. Period,’” she added.

In fact, the local police and sheriff’s departments are not the only local agencies that have no control over illegal immigration — the Mower County Court system is also unable to enforce federal immigration laws, meaning Mower County judges do not have the power to deport anyone, regardless of the circumstances.

When someone is charged with aggravated forgery or simple forgery, they won’t necessarily be deported after they are sentenced. Aggravated and simple forgery charges, loosely defined, are the act of falsely making, altering or using documents for the purpose of identification; hence why many people convicted of forgery are also found to be residing in the country illegally and using forged documents as identification.

According to Assistant Mower County Attorney Jeremy Clinefelter, the implementation of a state law enforcing immigration would be unconstitutional. States cannot enter into foreign policy, and immigration is a component of foreign policy, he said.

Clinefelter said the federal government becomes involved with a case once a person is in local custody and the circumstances suggest they are not a U.S. citizen. At that point, ICE is able to put a hold on the person.

Amazi said ICE places holds on inmates in a sporadic manner.

“There’s no set criteria that I’m able to put my finger on,” she said. “It’s selective. There’s certain people they’ll take and some they won’t.”

ICE spokesman Shawn Neudauer said the agency tries to look into any case where it learns that someone who is in custody may be in the country illegally. “As our resources permit, ICE places detainers on deportable aliens who are in jails based on their arrests on criminal charges or convictions,” he said.

Neudauer said ICE is only notified of a potential illegal immigrant after he or she is arrested and booked for a crime.

If ICE chooses to place a hold on someone, that person will be transferred to federal custody for investigation either after they post bail or after they are sentenced. An individual who has been convicted of a crime and who is in the country illegally can be deported almost immediately, consistent with the Immigration and Nationality Act of 1996, Neudauer said. Additionally, federal immigration judges can, after due process, order the deportation of an illegal alien whether or not that person has been charged with or convicted of committing another crime.

Once a person’s case is seen in federal immigration court, he or she can appeal the decision up the chain of courts. Neudauer said some individuals could end up staying in the country for years while appealing their case; however, this is not the usual circumstance.

Clinefelter said illegal immigration is a civil matter, while forgery is a criminal matter. When Mower County judges sentence a person on forgery charges, they have to be sentenced based on Minnesota Sentencing Guidelines, Clinefelter said.

“At sentencing, the judge will sentence to the probationary period, which the judge cannot deviate from under Minnesota law — 10 years for aggravated forgery or three years for simple forgery,” Clinefelter said in an e-mail. “The probation is unsupervised if the subject is removed (deported) and the only conditions are do not illegally re-enter the country and submit to a DNA sample.”

Since most people placed on ICE holds and investigated after their criminal convictions are deported in a swift manner, Clinefelter said the taxpayers are no longer paying to house defendants or supervise them on probation.

Amazi said the deportation system would work more smoothly if ICE had more manpower or if the system was reformed altogether.

“(ICE) is doing the best they can,” she said. “Their gloves need to be taken off, and until you have a federal administration that let’s that happen, we will continue to have these issues.”

“This whole system is broken,” she added. “It’s just frustrating.”

      Disagree–we need new voters. People brave enough to buck the two party system elect someone willing to scrap some of the current laws or the way the laws are put in place.

      We need to move tax day to the day before election day and things will start changing. Government can’t run without money. If you had to pay taxes on Monday and vote on Tuesday you’d make different choices. Ever notice that election day is 6 months away from tax day???

      But the third quote is spot on. Look at Egypt right now. Our country encourages the activity as the “voice of freedom and liberty” over there but if it happened here it would be nut jobs, lunatics, uneducated people who don’t understand, etc….

        47% of US workers already don’t have any tax burden. And a good chunk of those who do pay taxes, pay too much throughout the year and are snowed into thinking they are getting money paid to them by the government when they get a tax return, when in reality they are letting the government hold their money at 0% interest over the couse of the year. So I don’t think putting tax day next to election day would solve anything. If nothing else, it would have politicians promising to run up more debt by proposing more services and lowering taxes. I think we’re currently experiencing how some of that works.

    Why is it that when an illegal immigrant was stopped for speeding & could not provide a license or proof of insurance on the vehicle was not arrested or detained? The only thing that happened was someone else in the vehicle with a license was told to drive. And who knows if that persons license was valid. They continued down the road with no insurance…what happens when they slide into someone at an intersection? They cant speak english, no license, no insurance…who pays?…we all do.

    A US citizen would have been in big trouble…but the cheek was turned & they drove off.

    This system is broken & it is very frustrating.

    One of the problems that many do not understand is that companies do check the documents of applicants. During the electronic verify process that are advised that the Social Security Number is valid. However they are not told if more than one person is using the number. I can not confirm this but have been told that this is true by people that have confirmed it.

    Yes the whole system is broken and it is very frustrating. The problem and solution lies at the steps of the US Capital Building and they are afraid to fix it.

    That’s why everyone needs to back SB 1070 Arizona style legislation and those who propose it. Once empowered local authorities could act. Every state in the union needs to sign on and show the feds solidarity in doing the will of the people according to constitutional law.

    The lousy corporate US presidents are fighting to support their major campaign contributors. The whole thing is about money, not law.

    Amazi, phillip and all the other law heads use catch phrase rhetoric to lesson their work load, they only pray they are handcuffed NOT to enforce illegal alien activity, because once authorized you’d need 3 more jails the size of the one you just built.

    I have found out that alot of illegals do understand and speak English–they just have a loss of memory when confronted by law enforcement. They just don’t compute–until they are let go and then they have a big laugh on us. When an illegal is stopped it should be common sense that an officer checks for a valid driver’s license, proof of insurance and proof of ownership of the vehicle. Right outside my house last summer I heard a crash–right across the street a vehicle with two spanish men hit a parked car–I ran to my phone and called the LEC. The two quickly changed positions in the car and the passenger got behind the wheel and tried to drive off–the neighbor who’s car they hit and I ran after them and caught them–waited about 20 minutes before law enforcement showed up. No insurance, what a surprise, no drivers license, what a surprise, and the changing of drivers was never addressed, what a surprise.

      Local chiefs and sheriffs are running around throwing their hands up in the air as IF they really wanted to help you. . . total lie.

      The people who really want to help you aren’t wearing badges, they’ll be carrying brief cases into the supreme court. Google them up and see how you can help them.

      Forget your local cops, deputies, sheriff, chief they are just bad actors in a poorly acted play.

    If immigration enforcement is under federal jurisdiction, and so is bank robbery, then why are local law enforcement officials supposed to enforce that, or any other “federal” crime?
    It makes no sense, until you realize that the federal government gets to pick and chose which laws it will NOT enforce.
    I think local law enforcement should just refuse to enforce ANY AND ALL federal law, if they cannot enforce even one of them.

    Pretty simple. It would be nice if someone with resources could put this into a movement to validate the hiring process, institute the boycott of each company, and to measure the results. I would support this, but am not the brilliant mind to create and manage the project.

      First of all, Austinalum, the Sheriff is a woman, not a “he.”

      Second of all, did you not read the story at all? Why is it so hard for you to understand that the local law enforcement can’t do anything about illegals without doing something unconstitutional? The ICE Spokesman even said the only people who can do anything about it is ICE as an agency or a federal immigration judge.

      It’s articles like this that are meant to educate people so they don’t believe exactly what you just commented.

        Ice refuses to do their job, there is actually no reason for them to even be in Minnesota until they function in the manner they were intended.

        With a 1070 style law in place they could coordinate with local agencies to disrupt and eventually eliminate the illegal alien plague that Austin is forced to put up with.

        Don’t bother with poppe she is a former local human rights board member who sided against enforcement of any kind concerning illegal aliens in Austin. NEVER forget it when you vote.

    I think there are two things here that are not addressed. The first being if they are allowed to stay here then taxes need to be paid. I believe they go for seven years without having to pay taxes. Think about the amount of taxes that would be paid to the state deficit if all immigrants had to pay taxes. The second thing should be a history lesson. Back when this country was young and New York was welcoming all immigrants into the country with open arms it was creating a disaster. Food resources and jobs for those many immigrants were depleting and there were many starving and homeless children and adults. Do we have the resources in this country to maintain the constant stream of immigrants coming into it? No! Eventually we will relive history but the whole country will feel the affects. Think about it.

    One more thing, we are a great nation but we need to take care of the homeless and staving that are here right now. Not only is this system broken but also is the many systems that provide human rights for those that have lived here all there life. I would love to say that we can open our arms and take care of the world but we need to admit that we can’t even take care of the citizens who have lived here all there lives.
